US Judge Mandates Release of Abrego Garcia from Immigration Detention

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without legal authority.

"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. After his return to the United States to answer human smuggling charges, he was detained in immigration detention.

In her decision, the judge pointed out that the government does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

Background of the Case

The legal challenge involve disputed assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing criminal case in Tennessee.

The judge, who was overseeing his petition to deportation in a Maryland district court, ruled that he must now adhere to the terms of his release from custody in Tennessee. This order shifts his monitoring to the jurisdiction handling his criminal case.
